1. Services Overview
Welcome to Moderatio("Platform"). Moderatio is a personal and shared financial control platform designed to help users manage bank accounts, track financial transactions, monitor debts, intelligently categorize expenses, and plan budgets.
The service is provided and operated by Moderatio Finance("We", "Us", or "Operator"), accessible via a web interface or mobile application.
These Terms of Use govern your access to and use of the Platform. By registering or using our services, you represent that you have read, understood, and fully accepted these Terms, as well as our Privacy Policy.
2. Registration and Account Security
To benefit from all the features of Moderatio, users must register an account and provide accurate, truthful information.
- Account Security: You are solely responsible for maintaining the confidentiality of your credentials (email, password, or third-party logins like Google) and for any activity performed under your account.
- Authorized Use:Use of the Platform is strictly personal and, where applicable, shared in a consensual manner among members of the same "Workspace".
- Legal Capacity: Registration is intended for individuals who are at least 18 years old (or of legal age under local jurisdiction) and have full civil capacity.
3. Rules of Conduct
Users agree to use Moderatio in good faith and in compliance with all applicable local, national, and international laws. It is strictly prohibited to:
- Insert false, fraudulent, or illicitly obtained financial transactions or account data;
- Reverse engineer, attempt to breach security, access restricted API code, or perform automated scanning without prior written authorization;
- Use Moderatio for fraudulent financial activities or money laundering schemes;
- Share access credentials with unauthorized third parties.
Violation of any of these rules may result in the immediate suspension or termination of the user's account, without prejudice to any applicable legal actions.
4. Plans, Billing, Subscriptions, and Refunds
Moderatio operates on a freemium model, offering both free and subscription-based plans (Premium plans).
- Billing and Web Payments (Stripe): Financial transactions performed via the web interface are securely processed directly by Stripe. We do not store your full credit card details.
- Mobile Billing and Distribution (Google Play Store): Purchases and subscriptions made within the mobile app distributed via the Google Play Store are subject to the billing terms and policies of Google Inc.
- Automatic Renewal: Paid subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless the subscription is cancelled by the user before the next billing date.
- Cancellation and Refund Policy: Subscriptions can be cancelled at any time through the web settings panel or Google Play Store subscription settings. In compliance with consumer protection laws, users may request a full refund within 7 (seven) days of the initial subscription purchase. Refunds requested after this period will not be granted, but access will remain active until the end of the paid billing period.
5. Privacy and Data Protection
The privacy and security of our users' personal data is of utmost importance. Processing of any personal data submitted to Moderatio is carried out in compliance with our Privacy Policy and applicable data protection regulations, including LGPD in Brazil and GDPR when applicable.
The purposes and legal bases for data processing, as well as your rights as a data subject, are detailed in our Privacy Policy, which is an integral part of these Terms.
6. Disclaimers and Limitation of Liability
No Financial Advice: Moderatio is exclusively a digital tool for organization and personal finance management. No feature or artificial intelligence (AI) report generated by the Platform should be interpreted as professional financial advice, investment recommendation, or tax planning.
Service Availability:The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We are not responsible for external network connection failures, third-party Open Finance integration errors, or data deletion caused by user error.
7. Changes to these Terms
We reserve the right to modify these Terms of Use at any time to reflect changes in our services, technology, or legal requirements. If substantial changes are made that affect your obligations or billing, you will be notified in advance via email or notice on the Platform. Continued use of Moderatio after modifications are published signifies your acceptance of the revised Terms.
